Terms of Service

These Terms of Service ("Terms") govern your use of the Shivers Property Management ("Shivers," "we," "us," or "our") website and our SMS/text messaging communications. By submitting a form on our website, checking a consent box, or otherwise providing your phone number to us, you agree to these Terms.

1. SMS Messaging Program

We offer two separate SMS programs on our website, each with its own consent checkbox on our contact, application, or tenant forms:

Non-Marketing (Transactional) Messages: Rental application updates, maintenance requests and scheduling, rent and payment reminders, lease-related notices and updates, and appointment and showing confirmations.
Marketing Messages: Promotional messages about available properties, offers, or other marketing communications from Shivers Property Management.

By providing your mobile phone number and checking the applicable consent checkbox, you agree to receive the type of messages associated with that checkbox.

2. Consent

Consent to receive SMS messages is not a condition of any purchase or service. You may opt in by checking the applicable consent checkbox(es) on our contact, application, or tenant forms. Non-marketing and marketing consent are independent: you may opt into one, both, or neither, and opting into one does not automatically opt you into the other. Message consent will not be shared with third parties for any purpose, including marketing.

3. Age Restriction

You must be at least 18 years old to use our SMS messaging service. By providing your mobile phone number and opting in, you represent and warrant that you are 18 years of age or older. We do not knowingly enroll individuals under 18 in our SMS program.

4. Message Frequency

Message frequency is low for both programs. For non-marketing messages, frequency varies depending on your application status, tenancy, and property needs. For marketing messages, you will only receive occasional promotional messages.

5. Message and Data Rates

Message and data rates may apply. Charges depend on your mobile carrier and plan. Shivers Property Management is not responsible for any fees charged by your carrier.

6. Opting Out

You may opt out of SMS messages at any time by replying STOP to any message you receive from us. This will opt you out of both the non-marketing and marketing programs. After opting out, you will receive a one-time confirmation message, and no further messages will be sent unless you opt in again. Please note that opting out of SMS messages does not opt you out of other required communications regarding your application or tenancy, which may be sent by phone, mail, or email instead.

7. Help

If you need help or have questions about our SMS program, reply HELP to any message, or contact us directly using the information in Section 11.

8. Supported Carriers

Our SMS program is available on most major US mobile carriers. Carriers are not liable for delayed or undelivered messages.

9. No Warranty on Delivery

We do not guarantee the delivery, timeliness, or receipt of any SMS message. Text messaging is not a secure or guaranteed method of communication, and you should not rely on it as your sole means of receiving time-sensitive information.

10. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised effective date. Continued use of our SMS program or website after changes are posted constitutes acceptance of the updated Terms.
